The Economic and Financial Crimes Commission (EFCC) on Tuesday withdrew a motion before a Federal High Court in Lagos for stay of execution of a judgment which unfroze the 5.8 million dollars Skye bank account of former First Lady Patience Jonathan.
Justice Mojisola Olatoregun in 2016 ordered that the account be frozen on the grounds by the EFCC that the money was suspected to be proceeds of a crime.
However, on April 6, Olatoregun unfroze the account after Mrs Jonathan’s counsel, Mr Ifedayo Adedipe (SAN), challenged the propriety of EFCC’s action.
Dissatisfied with the unfreezing order, the anti-graft agency filed an application for a stay of execution of the order on April 6 and a notice of appeal challenging the judgment on April 7.
However, at the resumed hearing of the case on Tuesday, EFCC counsel, Rotimi Oyedepo, withdrew the two applications.
He did not give any reason for the withdrawal.
Oyedepo also withdrew Form 48 (notice of Committal to prison) and Form 49 (Committal to prison), which he said, was filed against Skye Bank in anticipation of a failure to obey the order of the court.
Olatoregun granted the withdrawal of both applications by the EFCC and Jonathan’s Form 48 and Form 49 respectively after Adedipe confirmed service of the application for withdrawal on the defendants.
