The Court of Appeal in Abuja has upheld the election of Ifeanyi Ubah as senator for Anambra South Senatorial District.
Justice Stephen Adah led a three-man panel in a unanimous judgement on Thursday which upturned the decision of the High Court of the Federal Capital Territory (FCT).
Justice Bello Kawu of the FCT High Court in Kubwa, Abuja had on January 17 nullified the election of Ubah as senator representing Anambra South.
However, Justice Adah, in the lead judgment, held that the FCT High Court did not have the requisite territorial jurisdiction in entertaining the case.
He added that from the record of proceedings before the lower court, there was no evidence that Ubah was served with processes in relation to the case.
The appellate court also awarded the cost of N250,000 each to be paid by the first and fourth respondent to Ubah.
