The Court of Appeals sitting in Ilorin, Kwara State, has overturned an earlier ruling by the state High Court nullifying the candidature of state’s All Progressives Congress (APC) governorship candidate, Abdulrahman AbdulRazaq.
The court gave the ruling on Tuesday.
A Kwara state High Court had in 2018 ruled that the dissolved Ishola Balogun-Fulani executive is the authentic exco, thus nullifying any candidate produced by the Bashir Bolarinwa executives.
The Appeal Court also ruled that state high court lack powers to entertain any suit against the Independent National Electoral Commission (INEC).
Justice Hamma Barka upheld all the four grounds of appeal filed by the APC, adding that the case of the Ishola Balogun-Fulani was defective in all ramifications.
The court said AbdulRazaq’s nomination by the APC National Working Committee was in order.
