The Supreme Court has dismissed two suits filed by Ned Nwoko challenging the election of Senator Peter Nwaoboshi as candidate of the Peoples Democratic Party (PDP) representing Delta North in the October 2, 2018 primary of the party held in Delta State.
Mr. Nwoko is married to Nollywood actress, Regina Daniels.
A five-man panel of justices led by Justice Inyang Okoro, on Tuesday, dismissed the suits for lack of jurisdiction.
“The originating summons is incompetent, judgement of the trial court is without jurisdiction.
“This court has raised the issue of jurisdiction suo moto (on its own) in the light of section 295(8) of the Constitution of the Federal Republic of Nigeria 1999 (as amended) as to when the cause of action arose,” Justice Okoro said.
The Court of Appeal had on May 30 upturned a Federal High Court judgement which removed Mr. Nwaoboshi as PDP senator-elect for Delta North Senatorial seat and installed Nwoko.
