National Industrial Court, Abuja, has dismissed a suit filed by Nigeria Union of Pensioners (NUP), against minister of labour and employment, Chris Ngige, for lacking in merit.
NUP instituted the suit after it was unable to get Ngige to approve the registration of the group under a new trade union.
In his judgement on Thursday, Justice Sanusi Kado held that the claimant’s suit had no reasonable cause of action, as it was an indispensable prerequisite for instituting a suit.
The judge said that the exhibit tendered by the claimant was a photocopy and as such the court could not act on it contrary to the provision of the Evidence Act.
He therefore said that there was nothing for the court to interpret, as there was no factual basis upon which the interpretation can be made.
The judge concluded by saying that the case lacked merit and dismissed it.
