A Federal High Court, Abuja, on Thursday fixed February 28 for hearing a bail application filed by suspended police officer, Abba Kyari.
The court decided on a date after rejecting an objection not to hear the application from the counsel to the National Drug Law Enforcement Agency (NDLEA), Joseph Sunday.
The NDLEA will respond to the bail application on the adjourned date.
Kyari’s lawyer Cynthia Ikena said the prosecution had been served her client’s bail application. But the prosecution denied it.
She prayed the judge to confirm the proof of service in the court file.
After going through the court file, Justice Inyang Ekwo directed Ikena to serve the prosecution with a copy of the bail application in open court and stood down the matter for an hour.
Kyari, through his lawyer, had on February 21, approached the court with an ex-parte motion and originating summons, seeking bail and asking the court to enforce his fundamental human rights which he alleged had been breached by unlawful arrest and detention.
In the main suit, the suspended deputy police commissioner urged the court to give an order directing the NDLEA to pay him N500 million for allegedly infringing on his rights.
He also asked the court to direct the agency to tender a public apology in national dailies.
