A Federal High Court in Abuja has declined to hear an application for bail by a deputy commissioner of police Abba Kyari on the grounds of ill health.
The suspended police officer is currently in the custody of the National Drug Law Enforcement Agency (NDLEA) over alleged drug deal.
Through his counsel, Cynthia Ikenna, Kyari told the court on Monday in an ex parte application that his health had deteriorated.
Ikenna prayed the court to release her client who is diabetic and hypertensive on bail pending the determination of the substantive suit.
She said the substantive matter is a fundamental human right suit in which Kyari is challenging the allegations against him.
But Justice Inyang Ekwo ordered the applicant to put the respondents on notice.
“Upon studying the process of the applicant and the averments in support of the application, I am of the opinion that the respondents be put on notice so they can answer to the averments. Therefore, applicant is hereby ordered to put the respondents on notice of all the processes in this matter,” he held.
The matter was adjourned till Thursday for hearing of the application.
The once-celebrated police officer is accused by the NDLEA of being involved in a 25kg cocaine deal.
Kyari is also under investigation by the police for alleged involvement in internet fraud perpetrated by convicted fraudster Ramon Abass aka Hushpuppi in the United States.
