A Federal High Court in Abuja on Wednesday refused to grant bail to suspended deputy commissioner of police Abba Kyari.
The police officer is facing drug-related charges filed by the National Drug Law Enforcement Agency (NDLEA) following his arrest on February 14, 2022.
In his ruling, Justice Emeka Nwite held that Kyari’s bail is at the discretion of the court in line with Section 161 (2) of the Administration of the Criminal Justice Act (ACJA).
The judge said Kyari has not shown any evidence to warrant the court to grant him bail.
He said bail can only be granted if the alleged offences carry a two-year term in line with Section 162 of the ACJA but in this case, the maximum sentence is 25 years.
Justice Nwite, on May 22, granted a temporary two-week bail to Kyari allowing him to return home and conclude the burial rites of his mother.
This was extended by a week following an application filed by Kyari.
After refusing to grant the suspended police officer bail, Justice Nwite ruled that the case should receive accelerated hearing.
