A Kaduna State High court on Tuesday dismissed the motion of no-case-submission filed by the leader of the Islamic Movement in Nigeria (IMN) Ibrahim El-Zazaky and his wife Zeenat.
El-Zakzaky and his wife are facing eight-count charges brought against them by the Kaduna State Government over allegations of culpable homicide, unlawful assembly and disruption of the public peace, among others.
At the last sitting on August 7, Justice Gideon Kurada fixed September 29 for ruling on the no-case submission after El-Zakzaky’s counsel Abubakar Marshall acting on behalf of the lead counsel Femi Falana, had asked the court to quash the charges preferred against the IMN leader by the government for not “disclosing an offence known to law contrary to Section 36 (8) and (12) of the 1999 constitution as amended”.
The prosecution counsel Dari Bayero also adopted his final arguments in the matter.
The court dismissed the no-case submission and ordered the continuation of trial.
El-Zakzaky and wife have been in detention since their arrest in December 2015 following a clash between his members and soldiers in Zaria, Kaduna State.
