A Federal High Court in Kano on Thursday dismissed a suit challenging the ban imposed on an Islamic preacher by the Kano State Government.
Justice Lewis Allagoa struck out the case following a notice of discontinuance by the plaintiff’s counsel Sale Bakaro.
The judge said the court struck out the case based on the application made by Mr Bakaro.
Sheik Abduljabar Kabara had in a suit number FHC/KN/24/2021 sought relief of the court to upturn the ban imposed on him by Kano government for “inciteful preaching”.
He said the action infringed on his fundamental right to life, personal liberty, fair hearing, freedom of thoughts, conscience and religion.
According to him, the action also infringed on his freedom of expression, peaceful assembly, freedom of movement, freedom from discrimination and right to acquire and own immovable property anywhere in Nigeria.
The respondent in the suit are Kano governor, attorney-general of the state, commissioner of police, Department of State Services and Nigeria Security and Civil Defence Corps.
A Chief Magistrates’ Court had on February 5, 2021, restrained the cleric from preaching and ordered the closure of his mosque pending the outcome of investigation being conducted by police and other security agencies.
