Justice Peter Kekemeke of an FCT High Court sitting in Nyanya on Thursday ordered a man, Abdujalil Balewa, to produce the originals of documents to prove that he is the son of late prime minister Tafawa Balewa.
The defendant was dragged to court by the late Balewa’s children – Mukhtar, Saddik and Umar – who claimed that he was not Balewa’s son.
The judge gave the order when defence counsel, Nnaemeka Otagburuagu, sought to tender a photocopy of the defendant’s indigeneship certificate in evidence, a request which the claimants’ counsel, Henry Okoro, objected to.
Kekemeke said that according to section 104 of the Evidence Act, the document was not admissible in evidence and ordered that the original copies be produced on next adjourned date being May 23.
The plaintiffs want the court to give an order of perpetual injunction restraining the defendant by himself, agents or servants from referring to himself as the son or grandson or blood relation of Balewa.
In addition, they want a public apology and retraction of all previous claims by the defendant in the print and electronic media that he is the son or grandson of Balewa.
